Terms of Use

These Terms of Use (“Terms”) govern access to and use of Clicktobuild.eu, the Clicktobuild platform, configurators, embedded tools and related services (collectively, the “Service”).

Clicktobuild is operated by Amatium, MB, a company established in Lithuania and based in Vilnius, Lithuania (“Clicktobuild”, “we”, “us” or “our”).

By accessing or using the Service, you agree to these Terms.

1. About Clicktobuild

Clicktobuild is a software-as-a-service (SaaS) platform that enables manufacturers, developers and other businesses (“Manufacturers”) to create and operate interactive product configurators.

Configurators may be created:

  • independently by the Manufacturer using Clicktobuild;
  • using materials and visual assets supplied by the Manufacturer; or
  • with design, visualisation, implementation or other assistance provided by Clicktobuild.

Clicktobuild provides the technology and infrastructure required to operate these configurators.

Unless expressly agreed otherwise, Clicktobuild is not the manufacturer, seller, distributor or supplier of the products displayed through a configurator.

2. Manufacturer Responsibility

Each Manufacturer is responsible for the products, specifications, descriptions, prices, materials, images and other information displayed through its configurator.

The Manufacturer is also responsible for ensuring that the information it provides is accurate, lawful and up to date.

Clicktobuild does not independently verify every product specification, price, technical characteristic, delivery condition or other information submitted by Manufacturers.

Any purchase, construction, supply or other commercial agreement is concluded directly between the customer and the relevant Manufacturer unless explicitly stated otherwise.

Clicktobuild is not a party to such agreements and is not responsible for their negotiation, performance, delivery, quality, warranty or fulfilment.

3. Configurations, Prices and Visualisations

Unless expressly stated otherwise by the relevant Manufacturer, configurations generated through Clicktobuild are provided for informational and planning purposes.

Visualisations may differ from the final manufactured product due to materials, lighting, display settings, production tolerances, product updates or other factors.

Prices, dimensions, specifications, availability and configuration options displayed in a configurator may also change.

A configuration, calculated price or generated summary does not constitute a binding commercial offer from Clicktobuild.

The Manufacturer is responsible for confirming the final product specification, price, availability, delivery conditions and contractual terms with the customer.

4. Leads and Customer Enquiries

Where a visitor submits an enquiry, contact request, configuration or other lead through a Manufacturer’s configurator, that information is intended for the Manufacturer associated with that configurator.

Clicktobuild does not sell such leads to third parties and does not operate the configurator as a lead marketplace unless explicitly stated otherwise.

Lead information may be processed through Clicktobuild’s technical infrastructure for the purpose of receiving, storing, transmitting and managing the enquiry.

The Manufacturer is responsible for responding to the customer and for any subsequent communication or commercial relationship.

Clicktobuild does not guarantee that a particular lead will result in contact, a quotation, a sale or any other commercial outcome.

5. Availability of the Service

We aim to provide a stable and reliable Service and take reasonable measures to maintain its availability.

However, uninterrupted or error-free operation cannot be guaranteed.

The Service may occasionally be unavailable or affected due to:

  • maintenance or software updates;
  • hosting, cloud infrastructure or network failures;
  • internet or telecommunications problems;
  • email delivery providers;
  • domain name or DNS providers;
  • third-party APIs or integrations;
  • security incidents;
  • browser or device-related issues;
  • infrastructure failures outside our reasonable control;
  • events of force majeure or other circumstances beyond our reasonable control.

Where reasonably possible, we will work to restore the Service and minimise disruption.

6. Lost or Delayed Leads and Data

While Clicktobuild takes reasonable measures to maintain the Service and transmit enquiries correctly, no online system can guarantee that every submission, notification or transmission will always be successfully delivered.

To the maximum extent permitted by applicable law, Clicktobuild is not responsible for indirect losses resulting from delayed, incomplete or unsuccessful transmission of a lead where the issue results from circumstances outside Clicktobuild’s reasonable control, including failures of third-party infrastructure or services.

Manufacturers should not rely on Clicktobuild as the sole system for business-critical data where independent backups or other safeguards would reasonably be appropriate.

7. Intellectual Property

Clicktobuild Platform

The Clicktobuild software, platform, interface, underlying technology, source code, system architecture, trademarks and other proprietary elements of the Service belong to Clicktobuild or its licensors.

These Terms do not transfer ownership of the Clicktobuild platform or technology to any Manufacturer or user.

Manufacturer Content

Content supplied by a Manufacturer, including its product designs, drawings, trademarks, photographs, visualisations, specifications and other materials, remains the property of the Manufacturer or its respective rights holders.

By uploading or providing such content to Clicktobuild, the Manufacturer grants Clicktobuild the rights reasonably necessary to host, process, reproduce and display that content for the purpose of providing the Service.

The Manufacturer confirms that it has the necessary rights and permissions to provide and use such content.

Content Created by Clicktobuild

Where Clicktobuild creates visualisations, graphical materials, configurator assets, designs or other content for a Manufacturer, ownership and usage rights shall be determined by the relevant project agreement, order, proposal, licence or other written agreement between Clicktobuild and the Manufacturer.

Depending on the project, such content may:

  • become the property of the Manufacturer;
  • remain the property of Clicktobuild while being licensed to the Manufacturer; or
  • be subject to another agreed licensing arrangement.

These Terms alone do not transfer ownership of custom-created content unless expressly stated otherwise in writing.

8. Acceptable Use

Users may not use Clicktobuild to:

  • violate applicable laws or regulations;
  • infringe intellectual property or other rights of third parties;
  • distribute malicious software or harmful code;
  • interfere with the security or normal operation of the Service;
  • attempt to gain unauthorised access to Clicktobuild systems or accounts;
  • misuse the Service for fraudulent, deceptive or unlawful activities.

Clicktobuild may restrict or suspend access where reasonably necessary to protect the Service, its users or third parties.

9. Third-Party Services

Clicktobuild may rely on third-party infrastructure, hosting providers, content delivery networks, email providers, analytics services, cloud services, integrations and other technology providers.

These services operate independently from Clicktobuild.

We are not responsible for interruptions or failures caused exclusively by third-party systems that are outside our reasonable control, although we will take reasonable steps to restore normal operation where possible.

10. Data Protection and Privacy

Personal data submitted through Clicktobuild is processed in accordance with applicable data protection law and our Privacy Policy.

Depending on how a particular configurator is operated, Clicktobuild may process personal data on behalf of a Manufacturer or for its own legitimate operational purposes.

Where required by applicable law, additional data processing terms may apply between Clicktobuild and the Manufacturer.

Manufacturers are responsible for complying with applicable privacy and data protection requirements regarding their subsequent use of customer enquiries and personal information.

Clicktobuild does not sell personal information submitted through Manufacturer configurators.

11. Fees and Paid Services

Certain Clicktobuild services may require payment.

Pricing, subscription periods, implementation fees, custom development fees and other commercial conditions may be specified separately in an order, proposal, subscription plan or service agreement.

Where separate commercial terms have been agreed, those terms will prevail over these Terms in relation to the relevant commercial arrangement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Clicktobuild shall not be liable for indirect, incidental or consequential damages, including loss of profit, loss of business opportunity, loss of anticipated revenue or loss resulting from unsuccessful or delayed customer enquiries.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Except where otherwise agreed in writing and to the extent permitted by law, Clicktobuild’s total liability arising from the Service shall not exceed the amount paid by the relevant customer to Clicktobuild for the Service during the twelve months preceding the event giving rise to the claim.

13. Suspension and Termination

Clicktobuild may suspend or restrict access to the Service where reasonably necessary due to:

  • non-payment;
  • security risks;
  • misuse of the Service;
  • violation of these Terms;
  • legal or regulatory requirements; or
  • activities that may harm Clicktobuild, its infrastructure, customers or users.

Termination of a paid subscription or individual project may also be governed by separate commercial terms agreed with the Manufacturer.

14. Changes to the Service

Clicktobuild is continuously developed and may be changed, improved, updated or modified over time.

Features may be added, changed or discontinued where reasonably necessary for technical, commercial, security or operational reasons.

We may also update these Terms from time to time. The latest version will be published on Clicktobuild.eu together with its effective date.

15. Governing Law

These Terms and the use of Clicktobuild shall be governed by the laws of the Republic of Lithuania, without prejudice to any mandatory legal protections that may apply under applicable law.

Any dispute arising from these Terms or the Service that cannot be resolved amicably shall be submitted to the competent courts of the Republic of Lithuania, unless applicable mandatory law requires otherwise.
